Your Content: You retain ownership of any content, data, or information you provide through the Service. By using our Service, you grant us a license to use, store, and process your content solely for the purpose of providing the Service to you.

8. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee 100% uptime. We reserve the right to:

• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO TRACEFORGE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless TraceForge and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Service caused damage to a third party

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will cease immediately.

Effect of Termination: Upon termination, we will cease providing the Service to you, and you will lose access to your account and any data associated with it. We may, but are not obligated to, provide you with a reasonable opportunity to retrieve your data before deletion.

12. Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of the European Union and the jurisdiction in which TraceForge s.r.o. is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable European arbitration association or through the competent courts in the jurisdiction where TraceForge s.r.o. is incorporated.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
